He wasn't "forced to crush it". He was free to reinstall the emissions equipment.
It's not the DMVs problem if he didn't keep the old parts.

Do all "off road" engines have to comply with EPA / DOT requirements? Do racing vehicles, not used on public roads, have to comply with EPA / DOT requirements?
The guy said he unregistered the truck to use it as a competition truck.
I don't know about "deleting", but I thought it was mostly removing the cat and modifying the engine programming? I am a little surprised it would cost $10,000 to get it back to EPA compliance.
It seems like there may be more to the story.

Not a lawyer, but have heard in civil case, if you do not show up for court the party that does wins what they asked for.
Could this be a issue?

I had a 2008 Ram. People were telling me for years to delete it and put a tuner on it. I had to replace a turbo and the company I bought it from said I would need a minor tuner for it to run right. If I ran it on the lowest tune when not towing a heavy trailer it would clog up the emissions. With no tune it ran fine.
I sold it a few months ago with all of the exhaust intact.
The guys deleting these newer trucks are crazy. There is plenty of power from the factory to pull anything they are rated for. Adding more will only break things and cost you more money.

Probably too little, too late.
He was obviously running it "on road". Claiming it's used for competition is a tough sell with no history of use in competition and not really a competition vehicle anyway.
I'm sure he could pay the lawyers to argue his case but probably cheaper to just reinstall the emissions equipment.

Dumb for not keeping emissions equipment. Then listed as deleted. Just wonder if he rolled coal at the wrong time. Got to wonder if someone from NJ DEQ replied to the ad and he boosted how much power and how cool it is to roll coal

And just think about how little outrage when the owner of a 15 YO car, can't afford to put valve guide seals in, gets forced to park because of a little smoke.
IMHO, if a vehicle is smoking, stop and check. If something is wrong, give a warning and "fix it ticket". But if the vehicle has been modified in a way that might cause the smoke, order a tow, send driver down the road kicking rocks. Sell the truck to highest bidder, under condition will be repaired to meet emissions before hits the street.

Your level of understanding diesels and their emissions systems is sorely lacking and/or misinformed.
Or in other words you just posted a short paragraph of complete Barbara Streisand.
PS if you needed a new turbo (likely just the vgt actuator and bought one that was not designed to be used with stock programming then that has nothing to do with emissions system deleting, you just bought the wrong turbo for what you wanted out of the truck)
That said, you also had Basically Dodges worst example of tier iv emissions reliability. Since it was a second year Tier IV model.
